News & Publications

Maryland's Governor has proposed reducing the estate tax exemption for fiscal year 2026 from $5 million to $2 million per individual and from $10 million to $4 million per married couple. This could have significant estate planning consequences. Although the proposed budget includes eliminating the inheritance tax, many beneficiaries were already exempt.

Maryland's intestate succession laws control how property is distributed if someone passes away without proper estate planning. The Estates and Trusts Article of the Maryland code provides specific rules about forming wills and trusts so property can pass according to a decedent's wishes, taxes can be minimized, and children can be cared for.
